What is this Law about?

This law sets out a fair and transparent process for how land is allocated to Members through:

  • Allotments (a parcel of land a Member can possess), and
  • Certificates of Possession (CPs) (legal documents confirming that right)
  • It supports housing, land management, and long-term community development.

Why was this Law created?

  • To uphold Yaq̓it ʔa·knuqⱡi’it’s self-governance over Lands
  • To provide clear, consistent rules for land allocation
  • To address housing commitments, including rent-to-own and mortgage agreements
  • To ensure the process is fair, transparent, and accountable

Who can apply?

Members may be eligible if they:

  • Are 19 years or older
  • Are in Good Standing (no outstanding debts to Yaq̓it ʔa·knuqⱡi’it)
  • Plan to use the land as their primary residence

What types of applications are available?

  1. New Allotment + CP
    • Apply for a new parcel of land and CP
    • Land must be available and designated by Council
  2. CP for Existing Allotment
    • For Members who already have land but no CP
  3. Housing Agreements (example: Rent-to-Own)
    • CPs will be issued once agreement terms are fully met

How does the process work?

  • Submit an application through the Lands Department (contact Terry at terry.babin@tobaccoplains.org)
  • Applications are reviewed and brought to Council for decision
  • Council approves allocations by Council Resolution
  • All approved CPs and allotments are registered officially

Key Conditions & Requirements

  • Land must meet zoning and land use plans
  • Maximum size for new allotments: 1 acre
  • A legal survey is required
  • Any fees or servicing costs must be paid
  • Construction timelines apply (start within 18 months-completion within 36)

Important Things to Know

  • Existing CPs remain valid
  • Council has final decision-making authority
  • There is no appeal process for allocation decisions
  • CPs and allotments can be transferred between Members
  • Land cannot be allocated in a way that blocks access to other lands

What happens in special situations?

  • Paid-off mortgages or agreements: CPs are issued once conditions are met
  • Default/foreclosure: Land to return to Yaq̓it ʔa·knuqⱡi’it and be reallocated
  • Land exchanges: May occur if fair and approved by Council

  • Conflict of interest rules are in place
  • Member information is protected and confidential
  • Decisions are made in the best interests of the community
